Although a municipality or special taxing district may require an owner or operator to obtain a permit to operate, it may not charge a fee for the permit. Additionally, the permit does not expire except in the case of a change of ownership in the real property, at which time the governmental entity may require the new owner to obtain a permit. Only one permit may be required for an apartment community. (Ind. Code § 36-1-20-3.5.)

Except as limited by the next sentence, for any fees assessed against owners or operators based on their rental properties, owners and operators may notify their residents of such fees and require them to provide reimbursement. (Ind. Code § 36-1-20-2.)  Owners and operators may not require their residents to reimburse them for fees assessed related to constructing rental units, such as building permit fees. (Ind. Code § 36-1-20-2.)

The Indiana Legislature has prohibited municipalities and special taxing districts from requiring owners and operators to participate in a class or government program as a condition for leasing rental units. (Ind. Code § 36-1-20-3.5.)
