Property owners are responsible for underground pipelines that it owns that transport natural gas from a gas utility’s meter to the various buildings on the property. The pipeline downstream from the utility’s meter is a considered a “gas distribution system” pursuant to federal law that is subject to pipeline safety regulations in 49 CFR Part 191, and 192, as adopted by the State of Indiana, and enforced by the Indiana Pipeline Safety Division for a master meter operator.

A gas distribution system is governed by 170 IAC 5 (state regulation), 49 CFR Part 191, and 49 CFR Part 192 (federal regulations). Under federal and state regulations, there are immediate notice requirements of certain incidents and mandatory reporting requirements, including submission of an annual report. Additionally, the federal government maintains a national registry of operators of pipelines, which must be kept updated. Further, 49 CFR Part 192 has detailed requirements regarding the construction, maintenance, emergency responses, plans, and ongoing operations of gas pipelines. 

Failure to comply with state and federal regulations can result in significant fines that accumulate daily. Thus, owners of pipelines should consult with their property’s attorneys and vendors who specialize in managing gas pipelines to ensure compliance with the regulations.
