During the 2023 Indiana Legislative Session, legislation passed intended to improve communication and community planning between leaders of military installations and their nearby communities by creating a “State Area of Interest.” However, language included in that legislation requires disclosure from property owners leasing any property within a 3-mile radius of Naval Support Activity Crane; Lake Glendora Test Facility (Sullivan, Indiana), and Grissom Air Reserve Base (near Peru, Indiana). Beginning July 1, 2023, for any lease entered or renewed for real property, including rental dwellings, the property owner must disclose in the lease that “the property is located near a military installation, within a state area of interest (as defined in IC 36-7-30.2-6) and may be impacted to some degree by the effects of the installation’s military operations.” Additionally, the lease must disclose that “local laws may restrict use and development of the property to promote compatibility with military installation operations.” Ind. Code § 32-31-1-21.1(a)
Practically, this is another disclosure for a property owner, but this should not impact operations for multifamily property owners. The 3-mile disclosure and creation of “State Areas of Interest” is intended to coordinate development around military bases to prohibit uses that might impact the military’s operations. For example, military commanders might be able to impact placement of power-generating wind turbines, large antennas, and solar panels, which might impact communication signals or airplane flight paths.
